Understanding Last Wills and Testaments in New Jersey

A Last Will and Testament ("Will") is the legal document that explains what happens to your property after you pass away.

Who will receive your home?
Who will care for your minor children?
Who will inherit family heirlooms?
Who will receive your bank accounts and personal belongings?
Who will care for your pets?
Who will oversee the administration of your estate?

A properly drafted Will answers these questions and provides clear instructions so your loved ones are not left guessing. Our goal is to create a document that passes smoothly through probate and minimizes the risk of disputes.

At ACP Law, we review your assets, discuss your wishes, and design a plan that reflects both your current needs and your long-term goals. Contact us online or at 732-288-6162 to learn more about wills and estate planning so your family is protected from unnecessary complications.

What is the Purpose of a Will?

The person who creates a Will is called the testator. In the Will, the testator names beneficiaries and directs how property should be distributed after death.

A Will allows you to control who receives your property, appoint a guardian for minor children, choose the person who will administer your estate (Executor), and provide clear instructions that reduce conflict among family members.

To be effective, the Will must follow New Jersey legal requirements.

General Requirements of a Will

Although laws vary slightly by state, a valid Will generally requires testamentary intent, meaning you intended the document to be your Will, and testamentary capacity, meaning you understood what you were signing. The document must also be executed free from fraud, coercion, or undue influence and must be properly signed and witnessed according to state law.

Failure to meet these requirements can invalidate the Will.

What Happens If You Die Without a Will?

If you pass away without a Will, you die intestate and New Jersey law determines who receives your property.

The law distributes assets to relatives in a strict order, typically to a spouse, children, parents, siblings, and then extended family. This may not reflect your wishes. Estranged relatives may inherit, unmarried partners receive nothing, and guardianship of minor children may ultimately be decided by the court.

Both Wills and intestate estates pass through probate. However, a clear and properly drafted Will usually moves through probate faster and with fewer disputes. There are also planning strategies that allow certain assets to pass outside probate entirely, and an estate planning attorney can help determine what works best for your specific circumstances.

The Risks of “Do-It-Yourself” Wills

Online Will templates have become increasingly popular, but they are designed for general situations rather than your specific family, finances, and goals.

Common issues include improper witnessing, unclear language, failure to address blended families, missing clauses, and invalid execution. These mistakes can lead to litigation or even cause a court to disregard the document entirely.
